These Terms of Service ("Terms") govern your access to and use of all software products, applications, websites, and services provided by Hentech Enterprise LLC ("Hentech," "we," "our," or "us").
By accessing or using any Hentech product, you agree to be bound by these Terms. If you do not agree, you may not use the services.
Scope of Services
Hentech Enterprise LLC operates multiple software products, including but not limited to:
- Guardian Safety – personal safety check-in and automated escalation software
- Guardian for Business – organizational workforce safety monitoring platform for HR teams, campuses, and field operations
- Hentech Agent – enterprise security and system monitoring software
- Hentech Shield – physical-location protection and monitoring software
- CookLens AI – AI-powered ingredient scanning, meal generation, and nutrition analysis application
Each product has distinct features, permissions, and limitations. Use of any Hentech product constitutes acceptance of these Terms and any product-specific disclosures.
Not an Emergency, Medical, or Monitoring Service
Hentech does not provide continuous human monitoring and does not guarantee that alerts, notifications, or escalations will be received or acted upon in time.
Guardian for Business Employer Terms
Organizations ("Employers") that access Guardian for Business agree to the following additional terms governing their use of the organizational dashboard and associated features.
Permitted Use
The Guardian for Business dashboard is permitted for use as a workplace safety tool only. Employers may use the dashboard to monitor employee safety status during active, scheduled shift hours, conduct welfare checks, and access escalation alerts and compliance reports.
Prohibited Use
Employers may not use the Guardian for Business platform to:
- Monitor employees outside of their scheduled shift hours
- Track employee location for any purpose other than safety escalation events
- Access an employee's personal Companion conversations, personal emergency contacts, or distress phrase data
- Share employee safety data with unauthorized third parties
- Use the platform as a substitute for required emergency response obligations
Employer Responsibility
Employers are responsible for obtaining appropriate consent from employees prior to deployment, complying with all applicable employment, privacy, and data protection laws in their jurisdiction, and ensuring that the platform is used solely for its intended safety purposes.
Company Code
Employers are issued a unique company code used to link employee devices to the organizational dashboard. Employers are responsible for maintaining the security of this code and for revoking access when an employee's relationship with the organization ends.
Audit Trail & Data Retention
Check-in logs, welfare check records, and escalation history generated through Guardian for Business are retained for a period determined by the applicable subscription plan and may be downloaded by authorized administrators for compliance and incident documentation purposes.
Campus & Institution Mode
Campuses and institutions that deploy Guardian campus mode agree to use the platform exclusively for student safety monitoring. Campus administrators may view the safety status of verified students only during active Guardian sessions. Campus mode does not grant institutions access to student personal data, Companion history, or off-campus activity.
Students may verify their campus email to join a campus dashboard and may disconnect at any time. Institutions are responsible for communicating the use of Guardian campus mode to students in accordance with applicable student privacy regulations.
Intelligent Companion Disclaimer
Some Hentech products may include an Intelligent Companion feature. This feature is software-based automation designed to assist user interaction. The Intelligent Companion does not represent a real person, emergency responder, medical professional, or authority and does not initiate emergency actions independently.
Minor Users
Guardian Safety supports users under the age of 16 through a restricted minor mode. Certain features, including the AI Companion and Journey Mode, may be limited or unavailable for minor users. Parents or guardians are responsible for supervising minor users' use of the application and for ensuring appropriate emergency contact and family plan configuration.
Notifications, SMS & Messaging
Certain Hentech products may send push notifications or SMS messages related to safety alerts, missed check-ins, welfare checks, and emergency escalation events. Users receive notifications only after explicitly enabling such features and providing consent. Message frequency may vary. Message and data rates may apply. Users and emergency contacts may opt out at any time by replying STOP or request assistance by replying HELP. Hentech does not send marketing or promotional SMS messages.
User Responsibilities
- Providing accurate and current information
- Maintaining up-to-date emergency contact details
- Understanding how each product functions and escalates events
- Ensuring device permissions, notifications, and connectivity are enabled
- Not sharing company or institution codes with unauthorized individuals
Failure to meet these responsibilities may impact the effectiveness of the services.
No Guarantee of Outcomes
Hentech does not guarantee prevention of harm, injury, loss, theft, or security incidents. Use of Hentech products is at your own risk.
Limitation of Liability
To the maximum extent permitted by law, Hentech Enterprise LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, loss of use, or personal injury, arising from or related to use of the services.
Service Availability & Third-Party Dependencies
Services may be interrupted, delayed, or unavailable due to maintenance, updates, network failures, third-party outages, or events outside Hentech's reasonable control.
Modifications to Services or Terms
Hentech reserves the right to modify, suspend, or discontinue any service at any time. Continued use after changes constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the jurisdiction in which Hentech Enterprise LLC is legally registered, without regard to conflict-of-law principles.
Subscription Services & Billing
Certain Hentech products offer optional paid subscription plans.
Consumer Subscriptions
Guardian Safety consumer subscriptions are processed through Apple App Store or Google Play. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. Refund requests are subject to Apple or Google refund policies respectively. Deleting the app does not cancel your subscription.
On iOS: Settings → Apple ID → Subscriptions. On Android: Google Play → Subscriptions.
Business & Institutional Subscriptions
Guardian for Business subscriptions are billed per enrolled worker or student per month at the applicable plan rate. Business subscriptions are invoiced directly and are not processed through the App Store or Google Play. Business clients may cancel with 30 days written notice to info@hentechenterprise.com. A 14-day free pilot is available to new business clients with no payment required during the pilot period.
